Local 97 – CDHA Nurses, Cease & Desist Order Issued

This is a message from NSGEU President Joan Jessome, as of 3:20 p.m. Tuesday, April 1st!!!

This afternoon, the union received a cease and desist order from the Labour Board:

“The Board was satisfied after an investigation of the complaint by the Program Officer that a stoppage of work has occurred and is continuing contrary to the provisions of the Trade Union Act.

 Effective April 1, 2014 the Labour Board orders those employees who are members of the Nova Scotia Government and General Employees’ Union, Local 97 who are participating in  the illegal work stoppage to cease and desist from participating in an illegal work stoppage and to report to work forthwith and perform their lawful duties as assigned by their employer.”

The union is asking all Registered Nurses to comply with the Labour Board order and report to their next scheduled shift.

Nurses who did not show up for their shifts will likely receive disciplinary letters from your employer. If you receive one of these letters, please contact us immediately at 424-4063 so we can file a grievance on your behalf.

If your manager asks where you were, simply explain you were protesting this government’s anti-worker legislation.

This does not mean our fight is over!

We are still picketing at the legislature to protest this tomorrow. If you are not scheduled to work, please come and join us! Meet us at the Halifax Marriott Harbourfront Hotel at 9 a.m.

Also, the NSGEU has given notice that we plan to hold a legal strike. Due to the incredible response of health care workers and concerned Nova Scotians speaking out against this legislation, it is now looking like we may be in a legal strike position as of 12:01 a.m. Thursday, April 3rd.

At that time, we will be taking further job action, and we need you out there with us, fighting this draconian legislation.

For those of you who stood with us, we thank you. We sent a very clear message to this government and the public, and we will continue. Please watch your email for updates from us over the coming days, as we will let you know what is planned!

    Nurses are important, highly educated and very hard to replace. Historically, integral people in important roles were treated in such a way so that they benefited from this employee-employer relationship (more bargaining power, high wages, benefits, etc…) and valued their job and felt respected. We’re currently in a minimum-wage economy. Corporations and public sector industries are all looking to pay as little as they can and still get results (and more profit) – seeing employees as nothing more than property… tools with the ability to talk back. Now they’re trying to prevent back-talking.

    You didn’t spend all that time, money and energy educating yourself to be ordered around senselessly and treated like a nuisance. As an uninvolved party, I’m proud of the nurses who didn’t show up to work, and would completely support any crowd funding initiative to pay the fines for those nurses, should they incur any.

    I lost any interest in hearing out the government side after hearing things like ‘there’s no proof that regulated nurse:patient ratios make a difference for the patient’ (research or not, that one’s kind of common sense, and patients aside, what about the nurses?…) and the essential services agreement is just insulting to everyone.

    You have my full support, and presumably that of most Nova Scotians. Don’t give up, you lean on the public for support for a change, and in the name of whatever is still sacred, stick it to them hard!

    I was just reading that other health authorities are cancelling surgeries to accommodate the transfer of surgeries from capital health. Has anyone approached the NSNU to ask if their nurses will be supporting their NSGEU counterparts by not doing the work that would have been performed by them or, are they instead going to be SCABS? This ought to be addressed as it’s anyone’s legal right NOT to perform the duties of someone on strike and in doing so, the NSNU will have a negative impact of the NSGEU’s efforts….and their own if they help accommodate a strike and this crazy bill passes.
