Local 1995 – CB Regional Municipal Police Services Union Files Grievance Over Changes to Lieu Time
As you are aware your employer has issues a new policy related to the collection and use of leave/lieu time effective this month, April 2025.
The new policy states that members can only accumulate up to 48 hours of leave/lieu time for the year. Once a member has reached 48 hours their leave/lieu time bank will be non-replenishable until the following year. All leave/lieu time will be paid out at year-end at the entitled rate of pay. The union has been informed that the employer will be restricting and denying members from using their leave/lieu time throughout the summer months.
It is the position of the union that this new policy violates the terms of your collective agreement. Management is not permitted to limit the amount of leave/lieu time that members have earned and entitled to.
Specifically, article 7.03 allows the employer to pay out officers who are in excess of 48 hours in their leave / lieu banks. They have this right and have enforced it. Before the implementation of the new policy officers were allowed to bank over 48 hours and continue accumulating leave / lieu time. Officers were paid out in excess of 48 hours but were allowed to replenish their leave / lieu banks when it fell below 48 hours. This has always been the case since the creation of the police service in 1995. The position of the union is that this new policy is a breach of the collective agreement, as it limits the leave/lieu bank to a maximum of 48 hours for the year
The union has filed a grievance citing this article and others that are in violation under the new policy.
Changes like this are frustrating and create confusion in the workplace. The union is working with the employer to find a resolution to this situation, but in the meantime the union has started the formal process by filing a grievance. Union President Sandra Mullen, Servicing Coordinator Dustin Rioux, and Labour Relations Officer Eddie Power met with the local executive yesterday to discuss the issues and the path forward. It was agreed that following the grievance process is the most efficient and effective way to get a clear and enforceable result. Any actions outside this process has the potential to slow the process down or stall it all together.
