Positive Resolution to Grievance re: Improper Use of Relief Employees
New Permanent Positions Being Created by the Employer
On Nov. 29th, 2016, the NSGEU filed a Policy Grievance (P-16-1288), alleging that your Employer was improperly utilizing relief employees as a means to avoid filling permanent positions. Article 11.17 of the Civil Service master agreement states that the Employer will not utilize casual, relief, temporary, and term appointments to avoid filling a permanent position.
The parties had discussed the dispute and had been unable to reach a satisfactory agreement and the Union referred the matter to adjudication in accordance with Article 29.05 of the collective agreement. On August 28, 2017, the Minister of Labour and Advanced Education confirmed the appointment of Lorraine Lafferty as Adjudicator and the parties were attempting to have this matter scheduled for a hearing.
On Dec. 29th, 2017, the parties signed a Memorandum of Settlement based upon an analysis of the hours worked by Relief Deputy Sheriffs at the Sydney Justice Centre.
We are pleased to report that effective Jan. 22, 2018, the Employer will create five (5) permanent full-time Deputy Sheriff 1-2 positions and convert five (5) Relief Deputy Sheriff 1-2 employees with the most service on staff at the Sydney Justice Centre, at the time of the grievance, into the newly created positions. The converted employees will be placed on the pay scale at their current level and retain their current anniversary date for meritorious service.
